The Chamber has finally approved the bill amending Articles 9 and 41 of the Constitution. Let’s see what this means and how the novelty has been welcomed by Oltremateria.
Safeguarding the environment and biodiversity is one of the fundamental principles of the Constitution of our Republic.
In fact, the draft law aimed at amending two articles of the Constitutional Charter, 9 and 41, has been definitively approved.
Let’s see how the two new articles are and what this entails.
Art. 9 reads “The Republic promotes the development of culture and scientific and technical research. It protects the landscape and the historical and artistic heritage of the nation. It protects the environment, biodiversity and ecosystems, also in the interests of future generations. the law of the state governs the ways and forms of animal protection.”
In a clear and precise way, it is therefore stated that the environment, biodiversity and ecosystems are part of the patrimonies protected by our State.
All this is done in the interest of future generations, as this heritage must remain unchanged and in the availability of the next.
Art.41, the second object of this historic change, is presented as follows: “Private economic initiative is free. It cannot be carried out in contravention of social utility or in such a way as to damage security, freedom, human dignity, health and the environment. The law determines the appropriate programmes and controls for public and private economic activity to be directed and coordinated for social and environmental purposes.”
It is addressed directly to companies as protagonists of this necessary protection.
A further limit is placed on their activity as they will also have to respect health and the environment, stressing also how the legislator can intervene to control and give guidelines that also take into account the environment.
